\nEnglish summary
\nThe subject of this thesis, which is: Limiting the debtor\u2019s legal competence to protect the creditors\u2019 rights, is one of the religious and legal issues that concern legal researchers for its great importance in life and daily activities of the individuals in our societies, either from the theoretical or practical aspects. So it is one of the most important and affecting subjects. Though this academic and practical significance, it has not been written fully in a previous detailed study in the context of the Yemeni Law. Until the present day, we can not find a specialized research in this connection to fulfill the practical requirements of the life of individuals and researchers alike; and also, to make up for the shortage in the Yemeni juridical library which lacks such a study.
\nThe importance and significance of this research are implied in its scope which includes most ways of protecting the general guarantee of creditors stipulated in the civil Egyptian and Yemeni laws. Most of these ways, greatly, are similar to the rule of putting the debtor under legal guardianship in the Islamic jurisprudence; but also, some of these ways are far from the Islamic jurisprudence such as the rule of confining the bankrupt debtor, a legislation stated in the Yemeni civil law and the \u201cinsolvency month\u201d rule stated also in the Egyptian civil law.
\nIn Addition to the previously mentioned importance, the Yemeni civil law No. 19 for the year 1992 modified by the law No. 14 for the year 2002 is one of the recent Arab civil laws; what means that it is a virgin law. No studies or legal researches \u2013especially the comparative ones \u2013have been conducted to enrich and crystallize it.
\nThus, this humble study, present before researchers, judges and jurists, is considered a new specialized addition to one of the Yemeni legal studies.
\nIn this study, the researcher followed the comparative method to strike a balance between putting the debtor under legal guardianship, because of his debt, in the Islamic jurisprudence and the similar statutes stated in the contemporary civil laws. The researcher illustrates the attitude of both the Egyptian and Yemeni laws, and makes a comparison between them on one hand and the rules of the Islamic jurisprudence on the other manifesting all opinions. He clarified the attitudes of some other legislations with elucidating the points of similarities and dissimilarities between limiting the debtor\u2019s legal competence in the Islamic jurisprudence and corresponding statutes in the contemporary laws.
\nThe researcher introduces the subject of his study in four chapters and a conclusion proceeded with an introductory chapter. In the introduction, he tackled the ways of attaining and protecting the individuals\u2019 rights in the primitive historical eras. Then, he shed light on the advancing legal rules that moving forward to civilization and their attitudes towards the debtor and concerning legislation to guarantee and protect the creditor\u2019s right. That all is presented in a comprehensive historical view followed by presenting the subject of the research, its importance, methodology, and plan.
\nAfter that, in the introductory chapter, the researcher tackled conceptions and general rules of placing someone under guardianship; whereas, he analyzed generally the idea of limiting someone\u2019s legal competence (definition, facts, kinds, legitimacy, the significance of legitimacy). Also, he talked about guardianship, legal capacity, disqualifications and what necessitates to put the individual under legal guardianship. The researcher explained the link between these disqualifications and religion concluding that indebtness is not included in these disqualifications, either in the Islamic jurisprudence or in the civil law.
\nThe study made it clear that limiting someone\u2019s legal competence differentiates generally according to its causes that the researcher had mentioned in the Islamic jurisprudence and the Egyptian and Yemeni civil laws.
\nThe researcher followed up these causes in general, ending up the last of these causes \u201cLimiting the debtor\u2019s legal competence to protect the creditors\u2019 rights\u201d, which is the title and subject of this thesis. He prefaced his thesis with explaining the second half of this title. He clarified what is meant by rights, general guarantee of the creditor\u2019s rights and the different ways of protecting them. He explained the meaning of legal behavior, legal act, commitment, nullity and voidness in the Islamic jurisprudence and the civil law. The study made a quick allusion to the ways of protecting the creditor\u2019s general guarantee in some old laws, the Islamic law, and contemporary legislation; where the researcher explained various conceptions, definitions and other legal and religious questions mentioned in the introductory chapter.
\nIn the first section, that is subdivided into two chapters, the researcher made every effort to manifest to what extent it is legitimate to put the debtor under legal guardianship and its conditions in both the Islamic jurisprudence and the civil law.
\nThe first chapter tackled the legitimacy of limiting the debtor\u2019s legal competence in the Islamic jurisprudence and the laws enforcing it. And other laws that stated the (insolvency month) rule such as the Egyptian civil law. The researcher concluded by explaining the importance and necessity of the legal guardianship and (insolvency month) to protect the creditors\u2019 general guarantee.
\nThe second chapter was devoted for talking about the conditions of putting the creditor under legal guarantee in the Islamic jurisprudence and the contemporary laws.
\nNow, the researcher moves to the second section which was subdivided into two chapters to manifest the legal guardianship\u2019s effects on the debtor. In the first chapter, he talked about the effect of legal guardianship on the debtor as a person before the law has the right of freedom and all other personal rights.
\nIn the second chapter, he talked about the legal guardianship\u2019s effects on his pre-and-post verdict behavior. He talked about the legal limits of the debtor\u2019s behavior and the limits of freedom he is entitled before enforcing the verdict of legal guardianship and bankruptcy in the Islamic jurisprudence.
\nAs for the Egyptian civil law, the researcher talked about the allegation of the debtor\u2019s behavior illegitimacy regarding the creditors\u2019 rights, (Policy allegation).
\nAnd in the Yemeni civil law, the researcher detailed and manifested the allegation of the creditor\u2019s behavior voiding. In the commercial law, he talked about voiding the bankrupt individual\u2019s behavior during the period of doubt. All these topics were entitled: \u201cThe legitimacy of the debtor\u2019s behavior pre-and-post the verdict of legal guardianship and insolvency month or bankruptcy. Then, he talked about preventing the debtor of using his properties, its nature and limits.
\nIn the third section, the study manifested the legal guardianship with regard to the creditors. This was illustrated in two chapters: in the first one, the researcher talked about these effects on the ordinary creditors. And in the second one, he shed light on the creditors of private rights in rem; where the study alluded to the exceptions stated by the legislator on the principle of equalization among creditors. These principles that are represented in the right of distraint and the right of retrieval.
\nIn the fourth section, the study talked about the causes of ending the state of legal guardianship and the insolvency month; and that was conducted through two chapters: the first one talked the causes of ending the state of legal guardianship and the insolvency month. The second chapter deals with effects resulted from the act both for the debtor the and his creditors in the Islamic jurisprudence, contemporary laws, (the Egyptian law-the Yemeni-and some other Arab laws).
\nThe researcher concluded his study with some results and recommendations:
\nThe results concern both the Islamic jurisprudence on one hand and the Islamic jurisprudence and the civil law on the other hand.
\nAs for the recommendations, they concern the Yemeni legislator to avoid and treat the points of shortcomings in the civil legislation, regarding the legislation rules of putting the bankrupt debtor under guardianship and the allegation of limiting his behavior.
